Did Biden Weaponize the DOJ Against Trump?
The claim that the Biden administration directed the Justice Department to prosecute Donald Trump as political warfare has no evidentiary support. The prosecutions were brought by career prosecutors and a special counsel appointed under AG Merrick Garland — the same DOJ that prosecuted Democratic Senator Bob Menendez, Democratic Representative Henry Cuellar, and Biden's own son Hunter Biden.

Zero evidence exists that the Biden White House directed the DOJ to prosecute Trump. The federal cases were brought by Special Counsel Jack Smith, appointed by career Justice Department official Merrick Garland. Biden's DOJ also prosecuted Democratic Senator Bob Menendez (convicted), Democratic Representative Henry Cuellar (indicted), and Hunter Biden — the president's own son — who was convicted on federal gun charges and faced separate federal tax charges.
The 'weaponization' narrative rests on a claim for which no supporting evidence has been produced: that President Biden or his White House staff directed the Justice Department to bring charges against Donald Trump. This claim has been investigated — by Republican-controlled congressional committees, by Trump's own defense teams, and by independent journalists — without producing documentary evidence, witness testimony, or communications supporting it.
The structure of the federal prosecutions makes the claim implausible on its face. Special Counsel Jack Smith was appointed by Attorney General Merrick Garland under 28 CFR Part 600, the special counsel regulations, specifically to provide independence from political direction. Garland himself is a career lawyer and judge — not a political operative. The cases were staffed by career prosecutors, not political appointees. The appointment of an independent special counsel is the mechanism the DOJ uses precisely when it wants to insulate a prosecution from political influence.
The most direct refutation of the weaponization claim is the prosecution record of Biden's DOJ against Democrats. Senator Bob Menendez of New Jersey — a Democrat — was indicted on bribery, extortion, wire fraud, obstruction of justice, and acting as a foreign agent. He was convicted in July 2024 on all counts and later sentenced to 18 years in prison. Representative Henry Cuellar of Texas — a Democrat — was indicted in May 2024 on bribery and money laundering charges along with his wife. These are high-profile prosecutions of prominent Democrats brought under Biden's DOJ.
Most significantly: the DOJ prosecuted Hunter Biden, the president's own son. Hunter Biden was convicted in June 2024 on all three felony counts in his federal gun case — making false statements on a federal firearms form by denying his drug addiction when purchasing a handgun in 2018. He separately faced a federal tax case in California that resulted in a guilty plea. A president weaponizing the DOJ to protect himself would not allow his own son to be convicted on federal felony charges. Biden notably did not pardon his son before leaving office, though he did grant him clemency after the convictions.
The pattern of charges against Trump — a federal indictment by Special Counsel Smith related to January 6th and election interference, a separate federal case on classified documents, and state-level cases in Georgia and New York — each arose from specific documented conduct, not political targeting. The Georgia case was brought by a locally elected district attorney with no connection to the Biden administration. The New York case was brought by the Manhattan DA, also locally elected. The idea that all of these prosecutions were coordinated by the Biden White House — without producing a single document, email, or witness to that coordination — requires believing a conspiracy that no investigation has been able to substantiate.
