Is Widespread Voter Fraud a Serious Problem in US Elections?

Despite persistent claims that voter fraud is rampant, every major investigation — including the conservative Heritage Foundation's own 40-year database — finds that proven fraud is vanishingly rare. Trump's own Attorney General, his own cybersecurity chief, Republican secretaries of state, and more than 60 courts all reached the same conclusion about 2020.

The Heritage database, maintained by conservatives specifically to document fraud, has found roughly 1,500 proven cases spanning four decades and billions of votes cast.

The best single source for evaluating voter fraud claims is the Heritage Foundation's Election Fraud Database — not because it's a liberal source, but because it's the opposite. The Heritage Foundation is one of the most prominent conservative think tanks in America, and they built this database specifically to document election fraud. After four decades of documented cases (the database covers cases back to the 1970s), Heritage has identified approximately 1,500 proven instances of election fraud — cases that resulted in convictions or official findings of wrongdoing. Over that same span, Americans cast well over 3 billion votes in federal elections alone. Heritage itself calls the database 'a sampling' rather than a comprehensive record, yet even taking it at face value, it represents a fraud rate so small it is difficult to express meaningfully as a percentage.

The type breakdown within Heritage's own database is just as revealing. Of all the cases documented across four decades, only about 10 involved in-person voter impersonation at the polls — the type of fraud most commonly invoked to justify strict voter ID laws. Only 41 cases involved non-citizens registering or voting. The Brennan Center's analysis of the Heritage database found that an American is more likely to be struck by lightning than to impersonate another voter at the polls. The Heritage database does not undermine the argument that fraud is rare — it confirms it, which is why critics of 'widespread fraud' claims frequently cite it.

After the 2020 presidential election, Trump and his allies filed more than 60 legal challenges in 12 states. The outcomes were overwhelmingly decisive. Eight conservative legal experts who reviewed 64 cases found that 30 of them proceeded to hearings on the merits — where Trump's legal team had the opportunity to present evidence — and Trump's side lost 29 of those 30 cases. Fourteen more were voluntarily dropped by Trump's own legal team. Twenty were dismissed before reaching a merits hearing. Judges appointed by Republicans, Democrats, and Trump himself repeatedly found that the evidence presented did not support claims of fraud. In one Pennsylvania case, Trump-appointed federal judge Matthew Brann dismissed the case, writing that the campaign was asking the court to 'disenfranchise almost seven million voters' based on 'strained legal arguments without merit.'

The people best positioned to know whether the 2020 election was stolen were members of Trump's own administration. Attorney General William Barr — one of Trump's most loyal cabinet members and a lifelong Republican — told the Associated Press on December 1, 2020: 'We have not seen fraud on a scale that could have affected a different outcome in the election.' Barr later testified before the House January 6 Committee that he had told Trump his fraud claims were 'bullshit.' Trump's cybersecurity chief, Christopher Krebs, whom Trump himself appointed to lead the Cybersecurity and Infrastructure Security Agency (CISA), issued a statement calling the 2020 election 'the most secure in American history' and said there was 'no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised.' Trump fired Krebs by tweet two weeks after the election.

In every state where 'massive fraud' was claimed, official audits and recounts confirmed the certified results. Georgia — where Trump demanded Republican Secretary of State Brad Raffensperger 'find' votes — conducted three separate counts of nearly 5 million ballots, including a full hand recount, and Biden's margin held each time. Arizona's Maricopa County underwent multiple audits, including a Republican-commissioned review by the firm Cyber Ninjas. Even that partisan review ultimately confirmed Biden's win. Wisconsin identified only 27 potential fraud cases out of 3.3 million ballots cast; a court found 'no credible evidence of misconduct or wide-scale fraud.' Pennsylvania completed a risk-limiting audit of more than 45,000 randomly selected ballots matching certified results within a fraction of one percent. The consistent finding across every state, every audit, and every court: the votes were counted accurately.
